KPK izdala več priporočil zaradi zaznanih korupcijskih tveganj pri nakupu stavbe na Litijski

Komisija za preprečevanje korupcije (KPK) je v primeru nakupa sodne stavbe na Litijski zaznala več korupcijskih tveganj, zato je vladi ter ministrstvoma za pravosodje in finance izdala več priporočil. Poleg tega je zaznala sum storitve kaznivih dejanj, katerih storilci se preganjajo po uradni dolžnosti, te pa že obravnavajo drugi pristojni organi.

Kljub ugotovljenim nepravilnostim KPK ni potrdila kršitev zakona o integriteti in preprečevanju korupcije, zato je postopek zaključila, so danes sporočili iz komisije.

KPK je postopek sprožila januarja 2024 na podlagi prijave, ki je vključevala domnevne nepravilnosti ministrstva za pravosodje pri nakupu stavbe na Litijski cesti 51 v Ljubljani ter domnevno vpletenost stranke SD, zlasti tedanjega glavnega tajnika SD Klemna Žiberta.

Na podlagi pregleda dokumentacije in javno dostopnih podatkov je KPK ugotovila, da je bil postopek nakupa stavbe izveden nepregledno, premalo skrbno in brez ustrezne strokovne podlage.

V dokumentaciji manjkajo ključni dokumenti in zabeležke, ki so pri tovrstnih investicijah izjemno pomembni za preglednost posla in krepitev integritete pri odločanju v javnem interesu. Na primer, ni razvidno, kdo je odločil, da je izbrana ponudba primerna za nadaljnjo obravnavo in izvedbo aktivnosti ministrstva, izpostavljajo v sporočilu za javnost.

Strokovne službe in vodstvo ministrstva prav tako niso bili usklajeni in obveščeni. Ministrstvo za finance ni preverilo racionalnosti in smotrnosti porabe sredstev, ministrstvo za pravosodje pa je postopek nakupa nadaljevalo brez zagotovljenih finančnih sredstev, je ugotovila KPK.

„Zaradi takšnih ravnanj je bil celoten postopek nakupa obremenjen s korupcijskimi tveganji,“ poudarja komisija. Zato je KPK ključnim akterjem izdala priporočila za izboljšanje ravnanja s stvarnim premoženjem.

Priporočila KPK vladi in ministrstvom

KPK je vladi priporočila, naj vsa ministrstva pozove k zagotavljanju preglednosti, doslednemu evidentiranju dokumentacije in beleženju prisotnosti vseh vpletenih na sestankih. Predlagala je ustanovitev delovnih skupin za večje projekte, ki naj vključujejo uporabnike nepremičnin in Državno odvetništvo, ustrezno načrtovanje časovnic projektov ter krepitev notranjih kontrol. Vladi je tudi priporočila oblikovanje in sprejem načrta integritete, ki bi ob pravilni uporabi lahko bistveno zmanjšal korupcijska tveganja.

Pravna nedorečenost glede političnih strank

Ker glavni tajniki ali generalni sekretarji političnih strank po zakonodaji niso opredeljeni kot uradne osebe, se KPK ni mogla opredeliti do vloge tedanjega glavnega tajnika SD. Je pa ministrstvu za pravosodje priporočila spremembo zakona o preprečevanju korupcije, s katero bi glavne tajnike političnih strank uvrstili med uradne osebe.

Druge prijave in ukrepi

V povezavi z zadevo je KPK prejela tudi prijavi junija in decembra 2023. Ti sta vključevali obtožbe o nasprotjih interesov, ponarejanju dokumentacije, grožnjah, šikaniranju in izsiljevanju na ministrstvu za pravosodje v zvezi z revizijo pravilnosti izvršitve državnega proračuna za leto 2023. KPK je ugotovila, da zadevo že obravnava Računsko sodišče, zato prijave ni ponovno odstopila. Sumljive primere pa je predala policiji in inšpektoratu za javni sektor.

Zadeva opozarja na nujnost dosledne preglednosti in integritete v javnih projektih, da bi se izognili podobnim tveganjem v prihodnje.
