Fides: Določanje obsega zdravstvenih storitev z novim odlokom je nezakonito

V zdravniškem sindikatu Fides menijo, da je določanje obsega zdravstvenih storitev z odlokom, ki ga je danes sprejela vlada, nezakonito. Opozarjajo, da se z njim posega v ustavno in zakonsko urejeno pravico do stavke ter da ni pravne podlage, na kateri bi vlada z odlokom določala obseg zdravniških storitev, ki sodijo v minimum delovnega procesa.

V sporočilu za javnost so zapisali, da vlada z odlokom širi zakonsko določen obseg minimuma delovnega procesa. Spomnili so, da zakon o stavki med drugim določa, da se način zagotavljanja pogojev predpiše z zakonom ali na zakonu temelječem odloku skupščine družbenopolitične skupnosti, ki določa dejavnosti in dela posebnega družbenega pomena.

“Ta določba torej predvideva možnost, da se način zagotavljanja minimuma delovnega procesa lahko določa tudi z odlokom, vendar mora ta odlok temeljiti na zakonu, kar pomeni, da mora biti za takšen odlok oziroma določanje načina zagotavljanja pogojev z odlokom podlaga (pooblastilo) v zakonu. Takšnega pooblastila pa ni ne v zakonu o zdravstveni dejavnosti in tudi ne v določbah zakona o zdravniški službi, ki oba konkretno določata nabor zdravniških storitev, ki sodijo v minimum delovnega procesa tekom stavke,” so zapisali v Sindikatu zdravnikov in zobozdravnikov Slovenije Fides.

Zaključili so, da se vlada sedaj “zelo očitno poslužuje nezakonitih postopanj in prisile za zaustavitev oziroma omejitev stavke”.

Vlada je namreč na današnji seji sprejela odlok, s katerim določa zdravniške storitve, ki jih morajo zdravniki opravljati v času stavke zdravniškega sindikata Fides. Med drugim gre za storitve za ranljive skupine, storitve s stopnjo nujnosti zelo hitro, izdajo zdravniških potrdil in bolniških listov, napotitve pacientov na nadaljnje zdravljenje in zagotavljanje informacij o zdravstvenem stanju oskrbovancev v domovih za starejše in posebnih socialnovarstvenih zavodih ter druge storitve, potrebne za uveljavljanje pravic iz socialnih zavarovanj.
